Alongside Stuart Mathews, a corporate lawyer based in London, we represented an African oil company in a dispute arising from a share purchase agreement governed by English law in respect of an interest in oil blocks in Ghana. This matter involved questions concerning, inter alia, the allocation of certain tax liabilities in the relevant country between the parties. Stuart’s in-depth knowledge of the negotiations and rationale underlying the provisions of the SPA was key to winning this case. Combining his knowledge of corporate law and our dispute resolution skills, we managed to secure three awards in favour of the purchaser. In fact, Stuart even very eloquently pleaded during the hearing!

Alongside Anne-Sophie, we successfully represented Alphamix (a Mauritian company) before the Privy Council (the highest court of appeal for certain Commonwealth jurisdictions, made up of the judges of the UK Supreme Court) against a Mauritian state entity (the ‘Rivière-du-Rempart council’) to reinstate an arbitration award on the construction of the ’ Rivière-du-Rempart market’, which awarded Alphamix damages in excess of EUR 16 million and which the Supreme Court of Mauritius had annulled. We worked hand in hand with Anne-Sophie and her team at Afralaw to cover aspects of Mauritian and French domestic arbitration laws (the former being based on the latter) and to present Alphamix’s case in a manner that would convince some of the brightest legal minds of the United Kingdom. We succeeded in doing so thanks to our very effective teamwork. The award was upheld.
